Vaping: The Silent Killer Hiding In Your Teen’s Pocket

Vaping is often marketed as a safer alternative to smoking, but for teens, it’s anything but safe. Why Vaping Is Dangerous

Three words…  UNREGULATED, UNREGULATED, UNREGULATED.  Vaping might seem harmless compared to smoking cigarettes, but the truth is, it comes with its own set of serious health risks—especially for teens. The aerosol produced by e-cigarettes contains harmful chemicals, including nicotine, which is highly addictive and damaging to developing bodies.

Before any new tobacco product can be legally introduced to the U.S. market, companies must go through the Pre-Market Tobacco Application (PMTA) process, overseen by the FDA. This process is designed to ensure that the product is “appropriate for the protection of public health,” requiring extensive scientific evidence to support this claim. However, the process is anything but simple—it’s lengthy, complex, and costly.

The PMTA process was introduced in 2016, following the Deeming Rule, which expanded the FDA’s regulatory authority to include e-cigarettes, e-liquids, and other electronic nicotine delivery systems (ENDS). Under the Deeming Rule, the FDA’s definition of a New Tobacco Product includes any product not commercially marketed in the U.S. as of February 15, 2007, as well as any modified tobacco product marketed after that date. This means that nearly all modern vaping devices, e-liquids, and even some components require PMTA approval, while traditional tobacco products like cigarettes, which were already on the market before 2007, are “grandfathered in” and exempt from these rigorous requirements.

Preparing a PMTA is not just time-consuming but also prohibitively expensive. Companies must compile detailed product descriptions, conduct scientific studies, and submit extensive data to meet the FDA’s requirements. The cost of preparing a PMTA for a single vape product has been estimated to range from $100,000 to over $1 million—a significant hurdle for smaller businesses attempting to navigate the regulatory landscape.

How Some Products Circumvent Regulations

Despite these stringent requirements, some companies have found ways to circumvent the law by creatively labeling their products. For example, a product may be marketed as an air freshener or labeled “not for human consumption” to avoid FDA scrutiny as a tobacco product. However, salespeople may “unofficially” convey to customers that these products are, in fact, vape liquids, functioning just like any other. This type of off-the-record communication bypasses the regulatory framework while still meeting consumer demand.

A similar approach has been observed with products like “bath salts” and “herbal incense,” which are often marketed for purposes other than their intended use as recreational drugs. These strategies exploit labeling loopholes to avoid direct legal oversight while maintaining their true market intent.

Understanding these regulatory workarounds highlights the ongoing challenges the FDA faces in enforcing compliance and protecting public health in the ever-evolving landscape of tobacco and vape products.

The Oral Health Risks of Vaping
